When do you need a DPO?
You may be legally required to appoint a Data Protection Officer if your organisation is a public authority, carries out large-scale regular and systematic monitoring of individuals, or processes special category or criminal offence data on a large scale. The ICO has a useful tool to you check whether your organisation needs a DPO. Click here.
Even where a DPO is not strictly required, many organisations choose to appoint external DPO support because they need independent oversight, specialist advice and a clear accountability structure.
Can you outsource the DPO role?
Yes. An organisation can use an external Data Protection Officer, provided the role is properly structured, independent, adequately resourced and able to report to senior management.
Why outsource your DPO?
Outsourcing your DPO gives your organisation access to independent, specialist data protection advice without the cost, delay or potential conflict of hiring in-house.
Many organisations try to add DPO responsibilities to an existing HR, IT, compliance or operations role. This can create pressure, lack of independence and potential conflict of interest. External DPO support gives you access to specialist advice without expecting one internal person to carry the whole function.
- Ongoing DPO advice and guidance, including support with UK GDPR, the Data Protection Act 2018, PECR and data protection governance.
- Data protection oversight, including policies, procedures, controls, RoPAs, DPIAs, LIAs, privacy notices and compliance records.
- Point of contact support, including help with data subject requests, complaints, ICO correspondence and internal escalation.
- Incident and breach support, including breach assessment, reporting decisions, internal records and lessons learned.
- Training and awareness, helping staff understand how to handle personal data and escalate risks properly.
- Data protection health checks, including practical reviews of governance, risk management, third-party arrangements and compliance gaps.
